Are prediction markets legal in India?
Short answer: Indian law has not clearly settled it. There is no statute naming prediction markets, state gaming rules differ, and the major platforms are offshore. Here is what actually applies, what is genuinely unclear, and what to check before you put money anywhere.
What the picture actually looks like
There is no single law that names them
Indian law does not have a statute written specifically for prediction markets. What applies instead is a patchwork: state gaming and gambling laws, the central rules on online gaming, foreign-exchange rules and crypto tax provisions. Different pieces pull in different directions.
The skill-versus-chance line matters
Indian courts have repeatedly distinguished games of skill from games of chance, and states treat them differently. Where an event contract sits on that line has not been settled for prediction markets as a category, so treat any confident 'it's definitely legal' claim online with suspicion.
State rules differ a lot
Some states restrict online real-money gaming far more tightly than others. Your state of residence, not the national picture, is often the part that actually affects you.
Most platforms are offshore
Moon.com and similar venues are global platforms, not Indian-registered operators. That means no Indian regulator supervises them on your behalf, and any dispute is governed by the platform's own terms.
Funding is crypto, not a bank transfer
Because these platforms are crypto-funded, the practical questions are about crypto rules — exchange KYC, the 30% gains tax, the 1% TDS on transfers — rather than about a rupee bank payment to a bookmaker.
Nobody here can give you a ruling
This page explains the landscape so you can ask better questions. It is not legal advice, and a page on an affiliate site is not a substitute for a lawyer who knows your state and your situation.
What to check before you deposit
- 01
Read Moon.com's terms of service and check whether users in India are eligible at all — the platform's own restrictions come first.
- 02
Check your state's position on online real-money gaming, since state rules are usually stricter than the national picture.
- 03
Speak to a qualified lawyer or chartered accountant if any amount of money matters to you. A short paid consultation is cheap next to a bad surprise.
- 04
Understand the crypto tax side before depositing: 30% on gains, 1% TDS on transfers, and record-keeping on every transaction.
- 05
If you proceed, start with an amount you would be relaxed about losing entirely while you learn how everything works.
Common questions
So is it legal or not?
There is no clean yes or no. Indian law has not squarely addressed prediction markets, state rules vary, and the platforms are offshore. Anyone giving you a flat answer is guessing. Get advice specific to you.
Is a prediction market the same as betting?
They look similar from outside, but the mechanics differ: a prediction market is a two-sided exchange where you trade against other users, prices move with collective belief, and you can exit before the event settles. Whether Indian law cares about that distinction for a given contract is exactly the unsettled part.
Do I have to pay tax on gains?
Crypto gains in India are taxed at 30% with no offsetting of losses, and transfers can attract 1% TDS. Keep every statement and confirm the current position with a chartered accountant — rules here have changed more than once.
Will my bank block it?
You are not paying the platform from your bank directly. You buy crypto on an exchange and move it. Indian exchanges require KYC, and your bank may ask about large exchange transfers.
What happens if the rules change?
They can, and they have before in adjacent areas. Do not treat a balance on an offshore platform as a safe long-term store of money, and withdraw profits you care about rather than leaving them parked.
